PREAMBLE:
To maintain maximum liberty, government must be created and remain at the point of balance of minimum laws, regulations, court decisions, and policies, to ensure the maximum individual freedom possible, while using powers of enforcement only as necessary to neither descend towards anarchy nor totalitarianism.
Liberty is expressed in the exercise and enjoyment of individual rights. Rights are your birthright as a free human being. Rights are not created by government, nor granted by government, nor can they be limited or destroyed by government, because rights are completely separate from government. They belong to each person, always.
This Bill of Individual Rights is to enshrine in this Constitution, the extent of delegated powers to government beyond which they cannot go, such that never again will individual rights be subject to any type of encroachment. The fundamental duty and responsibility of government therefore is to honor and protect individual rights, usually from government itself.
RIGHTS:
1. All rights are individual. There are no group or collective rights.
2. All rights are absolute. Any infringement on any right, regardless of crisis or severity, declared public purpose or justification, condition or emergency, declaration of emergency powers, war or pandemic, natural disaster, under any guise or pretense of “safety,” or any other factor, real or imagined by government — is prohibited.
3. These enumerated rights upon establishment of this Bill of Individual Rights, are permanent rights of the people, and are not subject to government suspension or revocation for any reason. Citizens have the right to a timely court challenge, with a representative citizen jury, for any violations of these individual rights.
4. Regardless of technology, policy, good intentions, law, regulation or court ruling, whether public or private, over all methods of communication, there shall be no encroaching upon the right of free speech and the open exchange of information.
5. The relationship of the individual to God is separate from government. The free exercise of that relationship, through religion, conscience, individual practice, thought, belief, opinion, or other, shall not be touched by government.
6. Citizens have a right to their own body and mind, and cannot be forced, extorted, threatened, coerced, influenced, pressured, DNA modified, subjected to medical or scientific experimentation, or infringed upon in any way, that affects their free will in being fully informed, and giving their full, valid consent, to anything that affects their body or mind.
7. Neither ideology, belief or thought, nor other creations of the mind, can be a cause of discrimination, differential treatment, or any separation or segregation, against any citizen.
8. Government shall make no law, regulation or policy, which includes prior restraint. No person shall be arrested nor property seized based on an act that might be committed in the future.
9. Rights are fully in force in the workplace, whether employee, employer, manager, or owner. However, the appropriateness of expressing certain rights at work, may be challenged, so long as opportunities outside work exist to exercise the same.
10. Every person has the right without any discrimination, to the equal protection of individual rights in law, regardless of whether that law is federal, state or local.
11. Every person has the right of peaceful assembly and protest, and to petition the government for redress of grievances.
12. Every person has the right to freedom of association with others, and the right to be free of forced association as well.
13. No person may be subjected to torture or to cruel or unusual treatment or punishment.
14. Every person lawfully in Australia has the right to: freedom of movement, choice of residence, modes of transportation, choices of energy use, engagement in commerce and investment, choices of lifestyle and other personal choices, and these shall not be infringed for any presumed public interest, scientific theory real or imagined, or for any purpose of social engineering.
15. Australian citizens have the right to be taxed only by lawfully created government departments, pursuant to the Constitution. The People shall not have income withheld, from payments or any other form of compensation, before taxes are due to be paid.
16. Citizens have the right to be free from invasive infrastructure and technologies that may be hazardous and/or used for monitoring and control. This shall include: 5G telecommunication, blue tooth public placement monitoring systems, any personal device including dual functioning recording and transmission of data devices, personal electronic devices, or any other potentially invasive or controlling infrastructure capabilities.
17. Every person is entitled to a natural environment, free from any government engineering or modification of the land, air or water.
18. Government shall not limit access to any private or home-school education opportunity, nor shall government compel any participation in any government education, system, curriculum or subject matter.
19. Private property shall not be taken for public use. Only by the consent of the owner, freely given, without coercion or influence, by agreement to sell, and for a price determined by the owner, retaining the right to refuse to sell, shall such property be transferred.
20. The right of the people to be secure in their persons, personal information, protection of privacy, family, home, correspondence, and property, from warrantless searches and seizures, shall not be violated. And no warrants shall issue but upon probable cause, supported by oath or affirmation, both describing and limiting, the place to be searched and the persons or things to be seized.
21. As The Constitution and the Bill of Individual Rights are the supreme law of the land, individual rights are not subject to international law, international organizations, actions of companies and corporations, international courts, nor any jurisdiction beyond the borders of Australia and no international agreements entered in to by the government are binding on the people.
22. Individuals shall be free from digital tracking, electronic monitoring, vaccine passports, other health passports and papers, microchip or nanochip technologies, wearables or facial recognition systems, QR or any other codes, or any monitoring, tracking, tracing capability, for the purpose of controlling law abiding citizens, including the government awarding of special privileges or the issuance of penalties or restrictions.
23. Govt shall not use “the public interest” for justifying any violation of individual rights. The Public interest shall be defined as the sum total of all individual decisions, free from any government restrictions, withholding of information or any method of enforcement or coercion.
24. Any person detained in custody has the right to remain silent and the right to consult with a lawyer. Excessive bail shall not be required, nor excessive fines be imposed, nor shall any person be compelled to be a witness against themselves.
25. Any person charged with a criminal offense is innocent until proven guilty. No person may be deprived of life, liberty, or property, except through due process of law.
26. In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial by an impartial jury of their peers, to be informed of the nature and cause of the accusation; to be confronted with the witnesses against them; to have compulsory process for obtaining witnesses and evidence in their favor; and to have the assistance of counsel for their defense, whilst also maintaining client privilege.
27. No person may be convicted of any criminal offense on account of any act or omission which did not constitute a criminal offense at the time when it occurred, nor be held liable to a heavier penalty than was applicable at the time the offense was committed.
28. No person shall be subject to trial or punishment twice, for the same crime arising out of the same facts.
29. Only through due process of the established referendum procedure in this Constitution, shall amendments be made to these enumerated rights.
30. The enumerated rights in this Bill are not limiting to any other rights, unstated, which are also retained by the people.
